A federal judge in Illinois denied McDonald's request to throw out a class action lawsuit over the McRib sandwich on Monday. The ruling allows the case to move forward after the judge rejected the fast food company's motion to dismiss.
The lawsuit was originally filed in December 2025. It claims McDonald's misled customers through false representations and omissions when marketing the sandwich. The plaintiffs argue the product was deliberately crafted to resemble a rack of pork ribs but is not made with pork rib meat. Instead, they allege the sandwich contains lower-grade pork products.
The complaint states that consumers were materially misled by deceptive labeling and marketing. The text notes that many buyers would not have purchased the item, or would have paid a lower price, had they known the composition of the patty. The McRib description on McDonald's website currently identifies the ingredient as a McRib Pork Patty without specifying that it is a rib cut.
McDonald's argued the lawsuit is meritless and distorts the facts. In a statement to Reuters, the company called the claims inaccurate. The firm also told ABC News that it has always been transparent about its ingredients so guests can make the right choice for themselves.
McDonald's must submit a formal response to the complaint by November 20. The case remains in the federal court system in Illinois.
